ESD #4 holds regular open meetings at 7PM on the first monday of each month at the Leon Springs Villa Clubhouse on Fahrenthold (map). Business of both ESD #4 and District 4 Fire and Rescue are conducted at these meetings. The public is invited, and an individual can be allowed 3 minutes to present concerns and questions to the commissioners. During the meeting, commissioners are not allowed to respond to questions in accord with Open Meetings Act rules (get a pdf of this), with the exception that they may respond with certain factual information or a statement of current policy (Sec. 551.042). Commissioners can discuss issues with the public during a break from their regular meeting. It is important to understand that failure to respond on any pending issue not on the advertised agenda for the meeting is not the commissioners choice, but is required of them. Factual information and current policy statements are not restricted by the Open Meetings Act.
The ESD is audited yearly, and must account for all monies collected for the ESD and distributed by the ESD. A statement of 2007 tax rates and revenues for ESD #4 can be found here. This indicates a taxable value of over $1,000,000,000, and a tax rate of 0.0599/$100 value. The ESD #4 had a fund balance of $77,098 at the end of the fiscal year. On page 6 of the 2008 Audit, factors influencing 2009 (current year) revenues and budgets indicate that ESD operating funding is expected to increase by 65% to $937,254. The tax rate is also increased to 0.0699.$100 value. The allocation to Leon Springs VFD remains the same as the previous year, reducing the percentage of collected funds which are allocated to Leon Springs VFD.
ESD #4 is a government entity, separate from the Leon Springs Volunteer Fire Department, Inc, a non-profit corporation that is contracted for services provided. The contract specifies payments from the ESD #4 to the Leon Springs Volunteer Fire Department for those services. The fire department in turn presents budgets and expenditure reports to the ESD. The fire department uses a Certified Public Accountant to prepare its monthly reports and yearly accounting, which are presented to ESD #4 at regular meetings. Thus, tax moneys allocated by the ESD to Leon Springs VFD are traceable from collection through expenditure.
